WHEREAS, IT WAS SUBSEQUENTLY DISCOVERED THAT STONE BRIDGE CREEK LLC IS NOT THE OWNER OF OUTLOT D, STONE BRIDGE CREEK 8TH ADDITION, AS SAID OUTLOT D IS OWNED BY STONE BRIDGE CREEK HOMEOWNERS ASSOCIATION. WHEREAS, THE FAILURE OF STONE BRIDGE CREEK LLC TO BE THE PROPRIETOR OF ALL THE LAND INCLUDED WITHIN THE FINAL PLAT AS REQUIRED BY §15-106 IS A FATAL DEFECT AND THE SUBDIVISION HAS NO VALIDITY, RIGHT OR PRIVILEGE AS AN ADDITION TO THE CITY OF LINCOLN, NEBRASKA. NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE RECITALS, THE APPROVAL OF THE FINAL PLAT OF STONE BRIDGE CREEK 11TH ADDITION IS HEREBY RESCINDED AND DECLARED TO BE NULL AND VOID AND OF NO EFFECT AND AS A RESULT OF THIS RESCISSION AND DECLARATION, THE FINAL PLAT OF STONE BRIDGE CREEK 11TH ADDITION IS DEEMED TO HAVE NO EXISTENCE AND SHALL BE CANCELLED OF RECORD.
