Approval of the minutes of the Board of Commissioners
meeting held on Tuesday, April 1, 1997. (A copy of these
minutes is on file in the Office of the Lancaster County
Clerk.)
2) CLAIMS:
Approval of all claims processed through Tuesday, April 8,
1997, with the exception that the vote of any Commissioner
who might have a conflict of interest in the payment of any
claim shall be deemed an abstention from approval for such
claims alone.
3) ITEMS OF PUBLIC PARTICIPATION:
It is the policy of the Lancaster County Board of
Commissioners to accommodate the public to the greatest
extent possible. Therefore, this agenda has been prepared
with items of greatest public interest at the beginning with
more routine items toward the end as a courtesy to those who
wish to speak with the County Board at this meeting. If you
are here to participate on an item and need special
consideration because of a schedule conflict or some other

day for each detainee, or at partial rates for 6-hour

Witness Unit, appeared and gave a brief presentation
regarding victim's rights.

Hudkins voted aye. Motion carried.
4) PUBLIC HEARINGS:
A. County Change of Zone Number 171, from AG Agricultural

Steinman opened the public hearing and asked if anyone
wished to appear in favor of the change of zone.
Paul Weckle, applicant, appeared and said he had met
with Sanitary Improvement District 3 to address some of
their concerns and as a result he said he has amended
his plan. Documentation was distributed regarding the
amendment (Exhibit "A"). He explained he would now
like to create four lots out of Lot 71 which contains
approximately 9.4 acres. Weckle said he has decided to
put in his own lagoon to ease the pressure regarding
concerns about sewer services and that Lot 3 would also
have its own opportunity to put in a lagoon. He noted
Lots 1 and 2 have been a part of the Sanitary
Improvement District for many years.
Steinman asked if anyone wished to testify in
opposition or in a neutral position.
No one appeared.
Campbell said they would need to go through the
preliminary plat process.
Mike DeKalb, Planning Department, said that was
correct. He explained the net lot size is slightly
under ten acres and the subdivision regulations require
any parcel created under ten acres in size to have
subdivision approval.
Steinman closed the public hearing.
MOTION: Tussing moved and Hudkins seconded approval
of Resolution Number 5483. On call Svoboda,
Tussing, Campbell, Hudkins and Steinman voted
aye. Motion carried.

Nghia Luong, claimant, appeared and indicated staff at
the Attention Center had placed his property into other
individuals accounts.
Campbell noted the recommendation was for approval in
the amount of $40.
Hudkins asked Luong if the calling card had been
cancelled.
Luong stated it was a prepaid card for $10.
Hudkins stated he felt they should approve the claim
for $50 in light of the information regarding the
prepaid calling card.
MOTION: Hudkins moved and Campbell seconded to
approve the tort claim for $50. On call
Svoboda, Campbell, Tussing, Hudkins and
Steinman voted aye. Motion carried.

need for an interlocal agreement between the County
and the City of Waverly.

Hudkins voted aye. Motion carried.
MOTION: Campbell moved and Hudkins seconded to
request the County Attorney's office, in
consultation with the Chief Administrative
Officer and Economic Development, to develop
an interlocal agreement with the City of
Waverly and other cities. On call Hudkins,
Svoboda, Tussing, Steinman and Campbell voted
aye. Motion carried.

1) MINUTES:
Approval of the minutes of the Board of Equalization meeting
held on Tuesday, April 1, 1997. (A copy of these minutes is
on file in the Office of the Lancaster County Clerk.)
MOTION: Hudkins moved and Tussing seconded approval. On
call Campbell, Hudkins, Steinman, Svoboda and
Tussing voted aye. Motion carried.
2) ADDITIONS AND DEDUCTIONS:
Approval of 26 additions and deductions to the tax
assessment rolls per Exhibit "A".
MOTION: Tussing moved and Campbell seconded approval. On
call Hudkins, Steinman, Svoboda, Tussing and
Campbell voted aye. Motion carried.
3) MOTOR VEHICLE TAX EXEMPTIONS:
Family Service
St. Thomas Aquinas Church
MOTION: Tussing moved and Campbell seconded to deny the
motor vehicle tax exemption for Family Service
because it was not timely filed. On call
Steinman, Svoboda, Tussing, Campbell and Hudkins
voted aye. Motion carried.
MOTION: Tussing moved and Hudkins seconded to approve a
motor vehicle tax exemption for St. Thomas Aquinas
Church. On call Svoboda, Tussing, Campbell,
Hudkins and Steinman voted aye. Motion carried.
Steinman recessed the Board of Equalization.
Steinman reconvened the Board of Equalization.
4) Tax exemptions filed on personal property and real estate
which were filed after the January 1, 1997 deadline:
Capital Soccer Association
Cedars Home Foundation, Inc (2 exemptions)
Cedars Inc.
Downtown Lincoln Foundation
First Lutheran Church
Fredrick Ozanan Building Corp
Houses of Hope of Nebraska, Inc.
International Church of the Foursquare
Lebanon Lodge #3 (2 exemptions)
Warren United Methodist Church
The exemption for Capital Soccer Association was withdrawn
because they have no personal property.
MOTION: Campbell moved and Tussing seconded to accept the
County Assessor's recommendation to approve late
filing penalties for Capital Soccer Association,
Cedars Home Foundation, Inc (2 exemptions), Cedars
Inc., Downtown Lincoln Foundation, Fredrick Ozanan
Building Corp, House of Hope of Nebraska, Inc.
International Church of the Foursquare, Lebanon
Lodge #3 and Warren United Methodist Church and to
withdraw the exemption for First Lutheran Church.
On call Campbell, Hudkins, Steinman, Svoboda and
Tussing voted aye. Motion carried.
5) Appeals filed on real estate for years 1994 through 1996 for
the following:
Young Men's Christian Association
Norm Agena, Lancaster County Assessor, recommended the value
be reduced to zero for 1994, 1995 and 1996. He explained
for 1997 a value would be put on the property since it has
been developed into four buildable lots.
MOTION: Campbell moved and Tussing seconded to accept the
County Assessor's recommendation and reduce the
value to zero for 1994, 1995 and 1996. On call
Hudkins, Steinman, Svoboda, Tussing and Campbell
voted aye. Motion carried.
Gene L. and Sandra J. Kalvelage
Agena explained that in 1993, prior to the 1994 reappraisal,
there were two houses sitting on the lot. One with an
address of South 1st Street and the other with an address of
112 "K" Street with a total value for both houses of
approximately $24,000. In 1994, when the reappraisal was
completed, one of the houses was inadvertently left off.
Agena explained the error was found a few months ago and the
other house was put back on for 1994, 1995 and 1996 which
increased the value from $17,600 to $30,300.
MOTION: Tussing moved and Campbell seconded to accept the
County Assessor's recommendation and deny the
appeal filed on real estate by Gene L. and Sandra
J. Kalvelage. On call Steinman, Svoboda, Tussing,
Campbell and Hudkins voted aye. Motion carried.

Svoboda, Tussing, Campbell, Hudkins and Steinman voted
aye. Motion carried.
