1) MINUTES: Approval of the minutes of the Board of Commissioners
meeting held on Tuesday, September 23, 1997. (Copies of these
minutes are on file in the Office of the Lancaster County Clerk.)
2) CLAIMS: Approval of all claims processed through Tuesday, September
30, 1997.
3) ITEMS OF PUBLIC PARTICIPATION: It is the policy of the
Lancaster County Board of Commissioners to accommodate the public to
the greatest extent possible. Therefore, this agenda has been
prepared with items of greatest public interest at the beginning
with more routine items toward the end as a courtesy to those who
wish to speak with the County Board at this meeting. If you are
here to participate on an item and need special consideration because
of a schedule conflict or some other problem, would you please let
us know now so we can try to meet your demands.
* Presentation of the County-City Volunteer of the Month Award to
Pat Galitz for her services with the Lincoln-Lancaster Women's
Commission.
4) PUBLIC HEARINGS:
An application for a Class E (Beer Off Sale Only) and a Class K
(Wine Off Sale Only) liquor license for T's Fast Stop located at
640 Prospector Court.
5) NEW BUSINESS:
A. Setting of a salary for Duane Austria, Deputy County Attorney,
at $32,000 per year, effective September 24, 1997.
B. A political subdivision tort claim filed against the Corrections
Department by Kellie D Labmelet for lost property, in the amount
of $10.
C. An agreement with Exclusive Healthcare, Inc. for billing services
to continue health insurance coverage for Lancaster County
employees under the Consolidated Omnibus Budget Reconciliation
Act of 1985 (COBRA), from September 1, 1997 to September 1, 1998.
D. An interlocal agreement with the Village of Hallam for law
enforcement services from September 1, 1997 to August 31, 1998,
billed at an hourly rate and reimbursement for mileage.
E. An agreement among the Board of Regents of the University of
Nebraska, Lancaster County and Lincoln Housing Authority for an
expanded food and nutrition education program, from September 1,
1997 to August 31, 1998, for a total of $21,016 of which $10,508
will be the County's share.
F. An agreement with the City of Lincoln for solid waste educational
services through the County Cooperative Extension Office, from
September 30, 1997 to August 31, 1998, for $14,625.
G. An agreement among the City of Lincoln, Lancaster County and
Cedars Youth Services, Inc. for juvenile diversion services,
from July 1, 1997 to June 30, 1998, for $98,508.

6) CONSENT ITEMS: These are items of business before the Lancaster
County Board of Commissioners which have been previously supplied to
each Commissioner in writing, which are relatively routine and which
are expected to be adopted without dissent. Any individual item may
be removed for special discussion and consideration by a Commissioner
or by any member of the public without prior notice. Unless there is
an exception, these items will be approved as one with a single vote
of the Board of Commissioners. These items are consideration of:
A. Setting of a public hearing for Tuesday, October 7, 1997 at 1:30
p.m. in the Commissioners Hearing Room on the first floor of the
County-City Building to add $208,000 to the City Buildings
Maintenance Fund as provided in an interlocal cooperative
agreement with the City of Lincoln.
B. Setting of a public hearing for Tuesday, October 14, 1997 at 1:30
p.m. in the Commissioners Hearing Room on the first floor of the
County-City Building for a Preliminary Plat for Blue Spruce
Estates, requested by J. Michael Rierden on behalf of Patter
Trust, for six single family lots and one outlot, on property
located southeast of North 148th Street and Holdrege Street in
Lancaster County, Nebraska (Preliminary Plat 97007).
C. Setting of a public hearing for Tuesday, October 14, 1997 at
1:30 p.m. in the Commissioners Hearing Room on the first floor
of the County-City Building regarding the adoption of the
Uniform Code for the Abatement of Dangerous Buildings in
Lancaster County, Nebraska.
D. Setting of a public hearing for Tuesday, October 28, 1997 at
1:30 p.m. in the Commissioners Hearing Room on the first floor
of the County-City Building to vacate a portion of "C" Street,
west of Third Street for 142 feet east and west and 60 feet
north and south in Martell, Nebraska (Resolution 5568).
E. Renewal of maintenance agreements with the following:

7) ANNOUNCEMENTS:
A. The Lancaster County Board of Commissioners will hold a meeting
on Thursday, October 2, 1997 at 8:30 a.m. in the Fourth Floor
Conference Room in the County-City Building.
B. A public hearing will be held on Tuesday, October 21, 1997 at
1:30 p.m. in the Commissioners Hearing room on the first floor
of the County-City Building for a street vacation, requested by
Joseph Berchenko, to vacate the east 25 feet of Southwest 16th
Street from West Burnham Street 1,309.51 feet south to the south
section line.
C. A public hearing will be held on Tuesday, November 5, 1997 at
7:30 p.m. in the Commissioners Hearing Room on the first floor
of the County-City Building regarding Lancaster County's
proposed "One-and Six-Year Road and Bridge Improvement Program
for the fiscal years beginning July 1, 1997 through June 30,
2003".
D. The Lancaster County Board of Commissioners meeting which is
broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast at
6:30 p.m. on Cablevision Channel 5.

MOTION: Campbell moved and Tussing seconded approval. On call Hudkins,

The County-City Volunteer of the Month Award was presented to Pat
Galitz for her services with the Lincoln-Lancaster Women's Commission.
4) PUBLIC HEARINGS:
An application for a Class E (Beer Off Sale Only) and a Class K
(Wine Off Sale Only) liquor license for T's Fast Stop located at
640 Prospector Court.
The Chair opened the public hearing and asked if anyone wished to
testify in favor of the application.
Peter Katt, attorney representing Duane Hartman, applicant, appeared
and explained T's Fast Stop holds a current liquor license at the
location, however, Duane Hartman has purchased the stock. Due to
Liquor Control Commission regulations a public hearing must be held
when there is a change in ownership with a new shareholder.
The Chair asked if anyone wished to testify in opposition or in a
neutral position.
No one appeared and the Chair closed the public hearing with action
to be taken on the application on Tuesday, October 7, 1997.
5) NEW BUSINESS:
A. Setting of a salary for Duane Austria, Deputy County Attorney,
at $32,000 per year, effective September 24, 1997.
MOTION: Hudkins moved and Tussing seconded approval. On call Svoboda,
Tussing, Campbell, Hudkins and Steinman voted aye. Motion carried.

MOTION: Campbell moved and Hudkins seconded to accept the Director's
recommendation and deny the tort claim. On call Tussing,
Campbell, Hudkins, Steinman and Svoboda voted aye. Motion carried.

employees under the Consolidated Omnibus Budget Reconciliation

MOTION: Tussing moved and Campbell seconded approval.
Terry Wagner, Sheriff, appeared and said the County contracts with four
villages. He explained the only substantial change in the contract is
the requirement that the Sheriff's Office charge mileage for the use of
the patrol cars. Reimbursement for mileage and overtime wages paid to
the deputies is made by the village.
Steve Mann, 1411 D Street, appeared in favor of the interlocal agreement.
ROLL CALL: Hudkins, Steinman, Svoboda, Tussing and Campbell voted
aye. Motion carried.

Campbell requested that Consent Item 6B be amended to reflect a date of
October 21 instead of October 14.
MOTION: Campbell moved and Tussing seconded to approve the Consent Items
with the amendment that Consent Item 6B be set for October 21,
1997. On call Hudkins, Steinman, Svoboda, Tussing and Campbell
voted aye. Motion carried.
