Approval of the minutes of the Board of Commissioners
meeting held on Tuesday, February 24, 1998. (A copy of the

Approval of all claims processed through Tuesday, March 3, 1998.
3) ITEMS OF PUBLIC PARTICIPATION:
It is the policy of the Lancaster County Board of
Commissioners to accommodate the public to the greatest
extent possible. Therefore, this agenda has been prepared
with items of greatest public interest at the beginning with
more routine items toward the end as a courtesy to those who
wish to speak with the County Board at this meeting. If you
are here to participate on an item and need special
consideration because of a schedule conflict or some other

8) ANNOUNCEMENTS:
A. The Lancaster County Board of Commissioners will hold a
meeting on Thursday, March 5, 1998 at 8 a.m. in the
Conference Room, #113, on the first floor of the County-
City Building.
B. A public hearing will be held on Monday, March 2, 1998 at
4 p.m. in the City Council/County Commissioners Hearing
Room located on the first floor of the County-City
Building for the 1998 annual review of the 1994 Lincoln-
Lancaster County Comprehensive Plan and the 33 separate
Comprehensive Plan Amendments.
C. A public hearing will be held on Tuesday, March 10, 1998
at 1:30 p.m. in the Commissioners Hearing Room located on
the first floor of the County-City Building regarding the
allocation of Keno funds.
D. The Lancaster County Board of Commissioners meeting which
is broadcast live at 1:30 p.m. on Tuesdays will be re-
broadcast at 6:30 p.m. on Cablevision Channel 5.

1) MINUTES: Approval of the minutes of the Board of Commissioners meeting

MOTION: Hudkins moved and Campbell seconded approval of the minutes
of February 24, 1998. On call Campbell, Hudkins, Steinman and
Svoboda voted aye. Motion carried.
2) CLAIMS: Approval of all claims processed through Tuesday, March 3, 1998.
MOTION: Svoboda moved and Campbell seconded approval. On call Hudkins,
Steinman, Svoboda and Campbell voted aye. Motion carried.
3) The Clerk asked if anyone present requested a change in the agenda. No
requests were made and the meeting proceeded as printed.
4) PUBLIC HEARINGS:
A. Vacation of a portion of Wittstruck Road in conjunction with the
construction of the Upper Little Nemaha Natural Resource District

The Chair opened the public hearing and asked if anyone
wished to testify in favor, opposition or in a neutral position.
Kerry Eagan, Chief Administrative Officer, appeared and informed
the Board that the vacation would deny access to a farmer's land.
He said that when the resolution is drafted it should indicated
that the road won't be vacated until completion of the new road.
Campbell asked if the Village of Bennet should be notified.
Mike Thew, Chief Deputy County Attorney, appeared and indicated
Diane Staab, Deputy County Attorney, had sent the Village of
Bennet a letter, however, she had not received a response.
The Chair asked if anyone else wished to testify.
No one appeared and the public hearing was closed.
The Chair noted that action will be taken on Tuesday, March 10, 1998.

position and noted they had acquired the right-of-way for the
road in fee from landowners and now own the property by deed.

Rick Leonard, appearing on behalf of the Habitat for Humanity,
distributed documentation (Exhibit A) containing the following:
- A map of the bike route
- A memo addressing the concerns of the Sheriff and County Engineer
- A copy of the signs marking the bike route
- An excerpt regarding their bike ride last year
MOTION: Campbell moved and Hudkins seconded approval of the Special
Events Permit with the changes as presented to the Board. On
call Campbell, Hudkins, Steinman and Svoboda voted aye.

Terry Wagner, County Sheriff, explained the agreement was entered into
last year. He noted that it had worked very well, however, the
agreement will expire on April 1, 1998. Wagner said they would like to
continue the proposal for the next few months until the new contract
can be negotiated which would be effective September 1, 1998.
MOTION: Campbell moved and Hudkins seconded approval. On call Campbell,
Hudkins, Steinman and Svoboda voted aye. Motion carried.
E. An agreement with Otto J. Smith for the purchase of
property located on the southeast corner of West Hallam
Road and Southwest 100th Street, for $5,130, for

FRIENDLY AMENDMENT: Campbell requested the Board approve Option
One as recommended by the County Attorney.
The seconder agreed.

G. An application for a Special Events Permit from the
University of Nebraska-Omaha Cycling Team to hold a
collegiate cycling road race on Sunday, March 29, 1998
from 11 a.m. to 3 p.m. at the Branched Oak State

Jeff Rotherham, President of the UNO Cycling Team, appeared and
addressed concerns by the Sheriff and County Engineer per Exhibit B.
In response to questions from the Board, Rotherham stated
that the race is a collegiate sport with 50 to 60 participants
from Iowa State, Kansas State, Minnesota and Wisconsin.
MOTION: Campbell moved and Svoboda seconded approval with the conditions
as outlined. On call Steinman, Svoboda, Campbell and Hudkins.
Motion carried.
H. An application for a Special Designated License from Jeffrey Rise of
Dave's Drive-In liquor in Fremont, Nebraska to hold a wedding
reception on Saturday, May 2, 1998 from 1 p.m. to 1 a.m. at the
community center located 7115 Lancaster Avenue in Denton, Nebraska.

Campbell asked if the Village Board of Denton would need to
take action on the license rather than the County Board
because the location is inside the village limits of Denton.
Mike Thew, Chief Deputy County Attorney, stated that the
Village Board would need to take action on the item.

hearing on Monday, March 2, 1998.
