AGENDA For A Meeting Of The Lancaster County Board Of Commissioners Tuesday,
December 1, 1998 At 1:30 p.m. In The County Commissioners Hearing Room,
First Floor, County-City Building.
1) MINUTES: Approval of the minutes of the Board of
Commissioners meeting held on Tuesday, November 24, 1998. (A
copy of these minutes is on file in the Office of the
Lancaster County Clerk.)
2) CLAIMS: Approval of all claims processed through Tuesday,
December 1, 1998.
3) ITEMS OF PUBLIC PARTICIPATION: It is the policy of
the Lancaster County Board of Commissioners to accommodate
the public to the greatest extent possible. Therefore, this
agenda has been prepared with items of greatest public
interest at the beginning with more routine items toward the
end as a courtesy to those who wish to speak with the County
Board at this meeting. If you are here to participate on an
item and need special consideration because of a schedule
conflict or some other problem, would you please let us know
now so we can try to meet your needs.

A. Designation of the official newspaper(s) for Lancaster
County for 1999, for publication of transportation

B. A supplemental agreement with the State of Nebraska,
Department of Roads regarding the share payable for
State-Aid Bridge Funds in connection with Project STPE-BR-3260(1),
Sprague Southwest. (19982836)
C. An agreement with Shauna Baird, an employee of the
Corrections Department, for repayment of overpayment of
wages, in the total amount of $1,754.03. (19982814)
D. Salary increases from Attorney I to Attorney II for the
following Deputy County Attorneys at the following annual

6) CONSENT ITEMS: These are items of business before the
Lancaster County Board of Commissioners which have been
previously supplied to each Commissioner in writing, which
are relatively routine and which are expected to be adopted
without dissent. Any individual item may be removed for
special discussion and consideration by a Commissioner or by
any member of the public without prior notice. Unless there
is an exception, these items will be approved as one with a
single vote of the Board of Commissioners. These items are

A. Setting of a public hearing for Tuesday, December 8, 1998
at 1:30 p.m. in the Commissioners Chambers, Room 112, on
the first floor of the County-City Building for a manager
application for Barry Alan Townsend in connection with a

7) ANNOUNCEMENTS:
A. The Lancaster County Board of Commissioners will hold a
meeting on Tuesday, December 1, 1998 at 8 a.m. in the
conference room located immediately west of the County
Commissioners Chambers, Room 113, on the first floor of
the County-City Building.
B. The Lancaster County Board of Commissioners will not hold
a meeting on Thursday, December 3, 1998 due to attendance
at the Nebraska Association of County Officials
convention in Omaha, Nebraska.
C. The Lancaster County Board of Commissioners will NOT meet
on the following dates due to the holidays:
Tuesday, December 22, 1998
Thursday, December 24, 1998
Tuesday, December 29, 1998
Thursday, December 31, 1998
D. The Lancaster County Board of Commissioners meeting which
is broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast

A. Comprehensive Plan Amendment No. 27b, 1998 Comprehensive
Plan Annual Review, requested by Peter Katt for Steve
Champoux, to revise the Land Use Plan to change 124 acres
from Agricultural to Low Density Residential at the
northwest corner of 134th and "A" Streets in
Lancaster County, Nebraska. (1998937) (Scheduled for
further discussion on May 18, 1999.)
B. A County Change of Zone, from AG Agricultural to AGR
Agricultural Residential, requested by Peter Katt for
Steve Champoux, on property at the northwest corner of
134th and "A" Streets in Lancaster County,

It was noted by the Chair that Larry Hudkins, County
Commissioner, was absent due to attendance at the Nebraska
Association of County Officials convention in Omaha.
1) MINUTES: Approval of the minutes of the Board of
Commissioners meeting held on Tuesday, November 24, 1998. (A

MOTION: Heier moved and Campbell seconded approval of the minutes of
November 24, 1998. On call Campbell, Heier and Steinman
voted aye. Motion carried.

4) PUBLIC HEARINGS:
Vacation of a portion of West Martell Road between Southwest
72nd and Southwest 86th Streets in Lancaster County, Nebraska.
The Chair opened the public hearing and asked if anyone wished to
testify in favor of the vacation.
Hugh Sieck, applicant, appeared and stated he was
representing himself as well as his grandmother, Antonia
Sieck. He explained his grandmother owns the property in the
southwest corner of Section 23 and that he owns the property
in the northeast corner of Section 23. He stated the bridge
has not been usable for several years, however, the road has
not been closed. He stated people are using his
grandmother's property to access a dirt road in order to
bypass the bridge. Sieck stated individuals are also dumping
garbage and that there is a great deal of target practice
taking place near the bridge.
Campbell asked Sieck if he has called the Sheriff.
Sieck stated he had not called, but some neighbors in the area have.
In response to a question from Steinman, Sieck stated Alan
Sieck is his father's cousin and currently rents part of the
property from himself.
Steinman reported that Alan has indicated he is not in favor
of the vacation.
In response to a question from Heier, Sieck stated the bridge
is located approximately a quarter of a mile to the east of
Southwest 86th Street.
Heier asked Sieck why he thought people would stop dumping if
the road is closed.
Sieck stated if the road were closed and barricades installed
it would not allow individuals
access.
Diane Staab, Deputy County Attorney, recommended against the
County installing barricades, due to liability and
maintenance issues, to close a road when it actually remains
a public road.
Campbell stated the road was closed and barricaded at
70th and Pine Lake Road for seven to eight years
because of the danger of the bridge being out.
Heier asked if the property is given up if the road is
closed.
Staab stated if the road were vacated the property would
revert to the abutting landowners.
Steinman stated her main concern is that the individuals who
use the road for access be in agreement with the vacation.
Campbell suggested speaking with Larry Worrell, County
Engineer's Department, regarding the difference between
closing the road and vacating it.
Heier stated he is opposed to vacating any road.
No one appeared in opposition and the Chair asked if anyone
wished to speak in a neutral position.
Mike DeKalb, Planning Department, reminded the Board that in
Planning staff's review it was noted that the road is not in
the Comprehensive Plan and is not a major road, however, the
vacation would create a problem of access coming from the
east to the bridge and would also create a land lock parcel
on the eastern side.
Campbell requested the hearing remain open.
The Chair recessed the hearing until Tuesday, December
8th when it will be reconvened.
5) NEW BUSINESS:
A. Designation of the official newspaper(s) for Lancaster
County for 1999, for publication of transportation
projects. (19982812)
MOTION: Campbell moved and Heier seconded to designate the Waverly
Newspaper, the Hickman Voice, Crete News
and the Lincoln Journal Star as the official
newspapers for 1999 for publication of Lancaster County
transportation projects. On call Campbell, Steinman and
Heier voted aye. Motion carried.
B. A supplemental agreement with the State of Nebraska,
Department of Roads regarding the share payable for

Attorney's recommendation and deny the claim. On call Campbell,

F. A political subdivision tort claim filed against
Lancaster County by Rod Rehm, on behalf of Thomas
Laughlin, for damages and injuries, in the amount of
$100,000. (19982833)
Diane Staab, Deputy County Attorney, recommended denial and
explained that the claim alleges negligence on the part of
CenterPointe which is not a County agency.
MOTION: Campbell moved and Heier seconded to accept the County
Attorney's recommendation and deny the claim. On call Heier,
Steinman and Campbell voted aye. Motion carried.

7) OTHER BUSINESS:
A. Clarence Molzer, 1555 SW 13th, appeared and
requested the road be maintained from south of Saltillo on
Second West. He explained there are six homes in the
development and that the width of the road and the culverts
meet the required standards.
Steinman stated they will need to speak with Don Thomas,
County Engineer.
B. John Austin, rural Lancaster County resident, appeared
and addressed floodplain issues on 1st Street between
South Street and A Street.
He also stated he would like to see inspections within the
County conducted by the County Engineer.
