What is Discrimination?

To establish a discrimination case, a complainant must be able to prove by a preponderance of the evidence that:

  • The complainant was subjected to unequal treatment by a covered individual, business, or housing provider.
  • This conduct was based on the complainant's status in one or more of these ten protected categories:
    • Sex
    • Age (only employment)
    • Race
    • Color
    • Religion
    • National Origin or Ancestry
    • Disability
    • Retaliation
    • Marital Status
    • Familial Status (only housing)
  • The conduct was in one of three covered areas: Employment / Housing / Public Accommodation
  • The complainant filed the complain within one year of the date of the alleged discriminatory action.
  • The complainant was treated differently because of his or her protected status, and not for other legitimate non-discriminatory reasons.

Please note that this is only a general statement of the legal standard for establishing discrimination. For example, additional and different legal standards apply to complaints of sexual harassment and of 'failure to reasonably accommodate a disability'. It is important to realize that not all unfavorable or unfair treatment is discrimination under the city of Lincoln ordinance. However, a complainant may have other legal remedies, which can be pursued whether or not a complaint is filed with the Commission.

How do I file a complaint with the Lincoln Commission on Human Rights?

LCHR is a city agency, that means we are only able to investigate complaints that take place within the city limits. Feel free to call and discuss your case with one of our investigators, if it does not fall under our jurisdiction we can refer you to the appropriate agency.

LCHR is a neutral investigative agency, we do not favor either party in a discrimination charge. We are independent fact-finders who provide case information to the Commissioners so that they may make a ruling.

  1. Call LCHR at 402-441-7624 and speak with an investigator who will help determine if your charge falls within our jurisdiction.
  2. Complete an intake form. You may download the applicable form, fill it out and e-mail or send it to us. The intake form provides us with contact information as well as a general picture of the discrimination which occurred.
  3. A Civil Rights Investigator from our office will review the intake form and contact you to set up an appointment to come to our office, answer any additional questions, and file an official complaint.
  4. LCHR will prepare the written formal complaint (called a charge) based on the information you have given us from the intake form and during your appointment. In order to be valid, this complaint must be signed by you, the Complainant (person filing the charge), and notarized by a Civil Rights Investigator.

Please note: It is not enough to fill out the intake form and send it to us. You must come in to sign the complaint. Without your notarized signature, we are not empowered to investigate.
